دور الموثق في تحقيق الامن القانوني و حماية الأطراف المتعاقدة

الملخص

يتدخل الموثق في تحرير و توثيق المحررات الرسمية مما يجعلها حجة على الناس كافة و تصبح لديها قوة في الاثبات تعادل في قيمتها احكام القضاء فلا يجوز الطعن فيه الا بالتزوير ، و هنا يتجلى دور الموثق بمناسبة تحريره للعقود و توثيق اتفاقات الأطراف المتعاقدة في حماية حقوقهم و تحقيق الامن القانوني ، و هو ما تهدف هاته الدراسة الى تبيانه من خلال التطرق الى الصلاحيات المخولة للموثق ، مع تبيان مدى فعالية و مساهمة الموثق في منح الطمأنينة و الاستقرار للأطراف و تسليمهم عقدا رسميا ذو حجية و نفاذ . Abstract: The notary intervenes in the editing and documentation of official documents, which makes it an argument for all people and has a force of proof equivalent in value to the rulings of the judiciary, so it may not be challenged except by forgery, and here the role of the notary is evident on the occasion of his editing of contracts and documenting the agreements of the contracting parties in protecting their rights and achieving legal security. This study aims to clarify by addressing the powers vested in the notary, while showing the effectiveness and contribution of the notary in granting reassurance and stability to the parties and handing them an official contract with authority and expiry.
