خصوصية أحكام إنتقال حيازة العقار الى الخلف بين ثبوت حق الملكية وحماية الحيازة

الملخص

تنتقل الحيازة الواردة على العقار من الحائز الأصلي بصفته السلف الى الحائز الجديد بصفته الخلف والذي يهدف الى الاستفادة من حيازة سلفه لاكتساب ملكية العقار أو استمرار وضعه القانوني كحائز. تهدف هذه الدراسة الى تسليط الضوء على حماية الوضعية القانونية لحائز العقار الجديد الذي انتقلت اليه الحيازة سواء كان خلفا عاما أو خاصا بين تحول وضعه المادي الظاهر المتمثل في السيطرة المادية الى حق الملكية وفقا للشروط القانونية أو اقتصار الحماية على استقرار وضعيته كحائز ، ومن أهم النتائج المتوصل اليها ان أساس الحماية ترتكز على تطبيق الأحكام القانونية لانتقال الحيازة بين تعدد الحالات وتوفر الشروط والتي تنعكس على مدى استفادة الخلف من حيازة سلفه لبلوغ التقادم المكسب أو حماية حيازته فقط دباستقرارها مع مراعاة أحكام الحيازة. Possession of real estate is transferred from the original possessor, in his capacity as the predecessor, to the new possessor, in his capacity as the successor, who aims to benefit from the possession of his predecessor to acquire the real estate or ensure the continuity of his legal status as a possessor. This study aims to shed light on the protection of the legal status of the new real estate possessor to whom possession has been transferred, whether they are a universal or particular successor. This protection is examined in terms of the transformation of his apparent physical status - represented by material control - into the right of ownership in accordance with legal conditions, or merely the limitation of protection to the stability of his status as a possessor. Among the most important findings is that the basis of protection rests on applying the legal rules for the transfer of possession, considering the multiplicity of cases and the fulfilment of conditions. This reflects the extent to which the successor benefits from the predecessor's possession to achieve acquisitive prescription or to simply protect his possession by ensuring its stability, while observing the rules of possession.
