The privacy of proof of electronics-commerce contracts in the Algerian legislation

Abstract

 In front of the technological and digital progress that the world is witnessing today, contracts and commercial transactions are now concluded through modern means of communication, This is what necessitated the various countries to work on the issuance of legislation related to this trade, Which in turn requires accompanying information technologies, It was necessary to develop frameworks to protect these electronic transactions by proving it with modern technologies, mainly represented in the authentication of the electronic signature. The aim of our study was searching for the privacy of proof of electronic commerce contracts in the Algerian legislation in light of these developments, where we find that the Algerian legislator was not immune to that; it issued Law No. 04-15 regarding the general rules for electronic signature and authentication as a mechanism to prove transactions that take place over the Internet Including , electronic commercial transactions which he later regulated according to Law 18-05 related to electronic commerce, the electronic signature was considered as proof of evidence in the field of e-commerce If certain conditions are met, and according to it, the electronic signature has full evidence in proof equal to the authenticity of the traditional signature.
