The Role Of International Contracts In Facilitating Global Commerce: Legal Frameworks And Enforcement Challenges
Keywords:
Digital Trade, Risk management, Enforcement mechanisms, Legal frameworksAbstract
The digital revolution has transformed contracting practices, with e-contracts under the UNCITRAL Model Law processing transactions 50% faster than paper-based systems. Modern contracts increasingly address emerging challenges through expanded force majeure clauses, ESG provisions, and AI-assisted drafting. However, significant challenges remain, including tensions between standardization and local legal traditions, uneven adoption of digital frameworks, and cybersecurity risks. Looking ahead, blockchain and smart contract technologies promise to automate performance and payment mechanisms, potentially generating $1.1 trillion in global trade efficiencies by 2030. As international commerce grows increasingly complex, well-structured contracts will remain indispensable for balancing innovation with risk management in an interconnected yet legally fragmented world.
