The right to withdraw from a contract as a means of protecting consumer satisfaction

A consumer may rush into a contract without due consideration and deliberation, due to inexperience and influenced by potentially misleading and deceptive advertising in light of modern economic and social changes. The rapid pace of transactions in our daily lives has led to the automatic signing of contracts without any examination or study. Therefore, to protect consumer satisfaction, the legislator intervened to grant consumers the possibility of withdrawing from a contract after its conclusion if it becomes clear that they acted hastily and that the contract is not in their best interest, given their position as the weaker party in the contractual relationship. This constitutes a departure from the principle of the binding force of contracts, a principle explicitly adopted by the legislator in Law No. 18/09, which amends and supplements Law No. 09/03 concerning consumer protection and the suppression of fraud.
