Abstract

Recognition of the principle of private ownership is essential, as the latter is a basic pillar in legal systems, because of its effective roles in the economic and social aspect thanks to the psychological strength that drives the individual to invest and preserve his money. The right to own property is a human instinct, so Islam approved it for the individual, respected it, and protected it. It was also laid down in the man-made laws, and this paper examined the conditions that are legally and legally required in order for private property to be protected and concluded in this semi-congruence between Sharia and the law. That the property be returned to what is permitted and accepted by Sharia or the law.
