Negotiation Mechanisms for Resolving Disputes Before the Competition Council

Algerian lawmakers have adopted negotiation mechanisms for resolving competition disputes as a means of facilitating amicable settlements between the Competition Council and entities engaged in anti-competitive practices, thereby avoiding litigation with the Competition Council and reducing the burden on the judiciary. However, their implementation in Algeria has not been very successful compared to other developed countries, particularly the United States, because the Algerian legislature has not established clear legal rules to support these mechanisms, To ensure their effectiveness and successful implementation in Algeria, the Algerian legislature must work to institutionalize negotiation mechanisms for resolving competition disputes by strengthening the legal framework and regulation governing their operation and making the culture of their use clear to economic actors so that they can be easily implemented in practice.
