حاجة الكفاءة الزوجية إلى التقنين في قانون الأسرة الجزائري

Abstract

إن أصل العلاقة الزوجية في عقد الزواج هو تحقيق الاستمرارية واستقرار الحياة الزوجية، وبناء أسرة أساسها المودة والرحمة، لذلك لابد أن يحرص كل مُقبل على الزواج مراعاة التقارب والتوافق في اختبار الطرف الثاني، لأن الاختيار السليم يُحقق الغاية من الزواج. تكمن أهمية هذه الدراسة في بيان دور وحاجة الكفاءة الزوجية في تحقيق استقرار العلاقة الزوجية في ظل التغيرات التي طرأت على مجتمعنا وأثرت على ميزان الكفاءة بين الزوجين وكذا إبراز المقاصد الشرعية والإشارة إلى حقيقة الكفاءة في القوانين المقارنة من أجل تقريب المواصفات بين الزوجين وتبيان حاجة المشرع الجزائري إلى تقنين الكفاءة الزوجية ضمنه. The foundation of marriage is to ensure continuity, stability, and the formation of a family based on love and mercy.Therefor, those seeking marriage must carefully consider compatibility with their partner,as the right choice fulfills the purpose of marriage. This study highlights the importance of marital competence in achieving stability in the relationship,especially in light of societal changes that have impacted the balance between spouses in Algerian family law. It also explores the legitimate purposes of marriage and examines the role of competence in comparative laws to promote harmony between spouses.
