Conformity of reclaimed agricultural lands in Algerian legislation

Abstract

منح المشرع الجزائري الحق لجميع الأشخاص الطبيعيين والمعنويين الذين يمكنهم إثبات استصلاح الأراضي، ولكن لا يملكون وثائق الملكية، أن يتقدموا بعقد امتياز وفقا للصيغة، على أساس إظهار خدماتهم واستثمارهم في الأرض قبل تاريخ نشر المرسوم التنفيذي رقم 432/21، بتاريخ الرابع من شهر نوفمبر 2021. ويحدد القرار الوزاري المشترك المؤرخ في 05 جمادى الأولى 1444 (الموافق 29 نوفمبر 2022) كيفيات ومواعيد مطابقة الأراضي المستصلحة، والذي يتضمن عددا من الإجراءات التي يمكن أن تعالج ملفات آلاف الأشخاص الذين يقومون بالاستصلاح وأوضاع المزارعين الذين يستثمرون ولكن ليس لديهم وثائق حقوق استخدام الأراضي، بإدراج الجميع في إطار سياسة تطهير العقارات الزراعية.
