نحو تبني بدائل للعقوبة في البيئة التنافسية الرقمية

Abstract

ان تبني سلطات المنافسة للأليات الحديثة و هي ما يسمى في قواعد قانون المنافسة بالتدابير الاحترازية والإجراءات التفاوضية، اللتان تعتبران بدائل للعقوبات لاسيما بعد فشل عدد من الأدوات القمعية الكلاسيكية كالغرامات مثلا في مكافحة الممارسات المنافية للمنافسة، وعدم كفايتها للإصلاح الضرر الناجم عن التلاعب بالخوارزميات الذي يصنعه عمالقة المنصات الرقمية GAFAM. فشتان بين الواقع والمأمول ، فرغم اتسام هاته القوانين بميزة الحداثة، الا ان عدم قدرتها على التنظيم الفعال للمنصات الرقمية ومحدودية تطبيقها يمكن تبريرالهيكلي فه بعدم ملائمة مفاهيم نص معقد الإجراءات وكثير الشروط في بيئة رقمية تتطلب المرونة والسرعة. فرغم التطور الاقتصادي الذي شهده الاقتصاد العالمي على مدى العقدين الماضيين ، الا انه لا يزال مبكرا القول بنضج سياسة التفاوض واتخاذ بدائل للعقوبة واعتماد سياسة العلاج السلوكي بدلا من العلاج ي العالم الرقمي. Abstract: Competition authorities should adopt modern mechanisms, which are what are called in the competition law rules , precautionary reports and negotiating procedures , which are considered alternatives to penalties , especially after the failure of a number of classic repressive tools , such as fines , for example , in combating competitive practices , and their inadequacy to repair the damage resulting from manipulation with algorithms created by digital platform giants GAFAM . There is a difference between reality and what is hoped for , although these laws have the advantage of modernity , their inability to effectively regulate digital platforms and their limited application can be justified by the inadequancy of the concepts of a text with complex procedures and many conditions in a digital environment that requires flexibility and speed . Despite the economic development that the global economy has witnessed over the past two decades , it is still too early to say about the maturity of the negotiation policy , taking alternatives to punishment , and adopting a behavioral tratment policy instead of structural treatment in the digital word .
