دور التأمين الإلزامي عن المسؤولية المدنية في حماية المستهلك من خطر المنتجات الدوائية

Abstract

يعتبر التأمين عن المسؤولية ضرورة حتمية فرضها التطور التكنولوجي والصناعي الهائل وسيطرة الآلة على عملية الإنتاج، ما أدى إلى تنامي احتمالات الخطر الأمر الذي أضحى يشكل تهديدا مباشرا على صحة المستهلك وسلامته خاصة في مجال صناعة المنتجات الاستهلاكية ونخص بالذكر منها الأدوية. ومع تطور قواعد المسؤولية المدنية التي أصبحت تقوم على أساس عيب المنتوج لا خطأ المنتِج، وكذا تفاقم دعاوى المسؤولية الناتجة عن الأضرار التي تحدثها المنتجات الدوائية المعيبة، كان لابد من استحداث آلية تكون بمثابة ملاءة مالية توفر الحماية اللازمة للمنتج وتساعده في الاستمرار في نشاطه من جهة، كما توفر نوعا من الحماية لمستهلك هذه المنتجات من جهة أخرى، بل وجعلها إلزامية وهو ما ذهب إليه المشرع الجزائري من خلال كل من القانون 95-07 المتعلق بالتأمينات و المرسوم التنفيذي 96-48 المؤرخ في 17 جانفي 1996 المحدد لشروط التأمين وكيفياته في مجال المسؤولية المدنية عن المنتجات. وعليه تهدف هذه الدراسة للكشف عن دور التأمين الإلزامي عن المسؤولية في حماية المستهلك من خطر المنتجات الدوائية. كلمات مفتاحية: المسؤولية المدنية، المنتجات الدوائية، التأمين الإلزامي، المنتج، المستهلك. Abstract: Liability insurance is an imperative necessity imposed by the tremendous technological and industrial development and the control of the machine over the production process, which has led to the growing risk potential, which has become a direct threat to consumer health and safety, especially in the field of consumer products, especially pharmaceuticals. With the development of civil liability rules, which have become based on the defect of the product and not the fault of the producer, as well as the aggravation of liability claims resulting from the damages caused by defective pharmaceutical products, it was necessary to develop a mechanism that serves as a financial solvency that provides the necessary protection for the producer and helps him to continue his activity on the one hand, and also provides a kind of protection for the consumer of these products on the other hand, and even makes them mandatory, which is what the Algerian legislator went to through both Law 95-07 on insurance. Executive Decree 96-48 of 17 January 1996 laying down the conditions and modalities of insurance in the field of civil liability for products. Therefore, this study aims to reveal the role of compulsory liability insurance in protecting consumers from the danger of pharmaceutical products.
