Liability of commercial companies for infringement of digital rights "Palestinian digital rights since October 7, 2023 as an example"

Abstract

حاولت الدراسة البحث في مدى مسؤولية الشركات الرقمية العالمية عن انتهاك الحقوق الرقمية للفلسطينيين و لكافة مستخدميها عبر العالم، بسبب تعاملها الانتقائي مع طرفي النزاع غير المتكافئ في غزة منذ 7 أكتوبر 2023. تم التطرق للمبادئ الدولية المتعلقة باحترام الحقوق الرقمية بناء على المبادئ التوجيهية للأمم المتحدة بشأن الأعمال التجارية و حقوق الإنسان، و مسؤولية الشركات التجارية عن احترام حقوق أصحاب المصلحة، و هم مستعملي الخدمات الرقمية أو الالكترونية، و توصلت إلى أن الشركات المحتكرة للتكنولوجيا الرقمية و مواقع التواصل الاجتماعي استخدمت أساليب غير مشروعة في تعاملها مع طرفي النزاع، مما يلقي عليها بالمسؤولية في انتهاك حقوق الشعب الفلسطيني، و المشاركة في حرب الإبادة التي تمارسها إسرائيل ضده. Abstract: The study attempted to investigate the extent of global digital companies’ responsibility for violating the digital rights of Palestinians and all their users around the world, due to their selective dealings with both sides of the unequal conflict in Gaza since October 7, 2023. The international principles related to respecting digital rights were discussed based on the United Nations Guiding Principles on Business and Human Rights, and the responsibility of commercial companies to respect the rights of stakeholders, who are users of digital or electronic services, and it was concluded that companies that monopolize digital technology and social networking sites The Social Security Service used illegal methods in its dealings with both sides of the conflict, which places responsibility on it for violating the rights of the Palestinian people and participating in the war of extermination that Israel is waging against them.
