Abstract

تهدف هذه الدراسة إلى بيان النظام القانوني الذي يحكم المفاوضات في مجال عقود التجارة الإلكترونية، مساهمة منا في توضيح المعالم القانونية لهذه المرحلة الحساسة التي تسبق إبرام مثل هذه العقود، وذلك من خلال التطرق إلى ماهية التفاوض الإلكتروني، وتحديد الالتزامات والمسؤولية التي تنشأ عن هذه المفاوضات. نظرا للدور الفعال الذي تلعبه المفاوضات في حل النزاع الذي قد ينشأ مستقبلا في إطار إبرام وتنفيذ عقود التجارة الإلكترونية، أولت التشريعات المقارنة أهمية خاصة لهذه المرحلة، من بينها التشريع الجزائري الذي نظمها في قانون التجارة الإلكترونية 18-05 بعد أن أغفل عن تنظيمها في نصوص القانون المدني. بالتالي الإشكالية تتمحور حول الإطار القانوني للتفاوض في عقود التجارة الإلكترونية. Abstract: This study aims at stating the legal system which rules negotiations in the field of E- commerce contracts through the electronic negotiation and specifies the commitments and responsibilities that rise up from these negotiations. And, regarding the efficient role of such negotiation in solving the conflict which may occur in the future under the obligation and the execution of the E- commerce contracts, the comparing legislations gave an extreme importance to this stage, among which the “Algerian Legislation” which included it into the E- commerce law 18/05 after it refused to introduce it into the civil law texts, thus the Problematic is centered around the legal framework of negotiating the E-commerce contracts
