Abstract

إنّ غرفة التجارة الدولية (ICC) تؤدّي دور مهمّ في صياغة مصطلحات التجارة الدولية بشكل دوري، استجابة للتطورات المستمرة التي يشهدها قطاع الأعمال، حيث صدرت آخر نسخة عام 2020 تمثّل صكوك قانونية معترف بها دوليا، وتفسّر أحكام عقود التّجارة الدولية بشكل واضح بهدف التقليل من مخاطر اللبس الذي تشوب البائع أو المشتري. ويكمن الهدف من دراستنا في تحديد مختلف قواعد الانكوترمز الجديدة التي يُستحسن استخدامها من قبل أطراف العقود الدولية، وهو ما تسعى تحقيقه غرفة التجارة الدولية حين تفسير الأنكوترمز، لتعزيز الثقة بين المتعاملين التجار، وتيسير التجارة الدولية، وتنظيم عقود النقل الدولي للبضائع، مع الأخذ بعين الاعتبار مختلف وسائط النقل، عبر مراحل نقل أساسية أو سابقة أو لاحقة، وهو ما تنادي به قواعد روتردام 2008، التي تتوافق مع قواعد الانكوترمز المستخدمة في جميع وسائط النقل أو وسائط النقل البحرية والممرات المائية الداخلية، وهو ما يجسّد نقطة ايجابية جوهرية تعمل على تحقيقها غرفة التجارة الدولية. Our study aims to identify the various new incoterms that are desirable to use by the parties to contracts, this is what the International Chamber of Commerce seeks when interpreting it, to enhancing trust among traders, and facilitating international trade, especially regulation of contracts for the international carriage of goods, through different modes of transport, Through basic, prior or subsequent transport phases, this is advocated by the "Rotterdam Rules 2008", that conform to the Incoterms ® used in all modes of transport or maritime modes of transport, and inland waterway, This reflects a fundamental positive point for the International Chamber of Commerce.
