Crimes on e-commerce sites in the Algerian Penal Code

Abstract

تتعدد الجرائم التي تقع على المعاملات التجارية الإلكترونية ، حيث تعد جريمتي الدخول أو البقاء غير المشروع في المواقع ، الاعتداء على سير وسلامة المواقع بالتعطيل و التدمير من أخطرها و أعقدها من حيث الإجراءات المتبعة و الإثبات. هذه الدراسة تسعى إلى تسليط الضوء على أهم الإعتداءات و الجرائم التي تقع على مواقع التجارة الإلكترونية في التشريع الجزائري مع التركيز على أركانها بالشرح و التحليل ، ونظرا للضرورة الملحة و الجادة خاصة في مجال التجارة الإلكترونية سن المشرع الجزائري قانون التجارة الإلكترونية الذي يعد متأخر مقارنة بالمشرعين سواء الغرب أو العرب ، إلا أن هذا القانون كان تنظيما غير دقيق و واضح للجرائم الواقعة على التجارة الإلكترونية مما يجعلنا نعتمد على القواعد العامة في قانون العقوبات الجزائري. Offences on e-commerce sites are among the most serious offences in the Electronic Business Information System, where the offences of unlawful entry or stay on sites, assault on the operation and safety of sites by disabling and destroying are the most serious and complicated in terms of procedures and evidence. This study seeks to highlight the most significant attacks and crimes on the websites of electronic commerce in Algerian legislation, focusing on its elements by explaining and analysing In view of the urgent and serious need, especially in the field of electronic commerce, Algerian legislators have enacted the Law on Electronic Commerce, which is overdue compared to lawmakers both West and Arab, However, this law was an inaccurate and clear regulation of offences against electronic commerce, making us rely on the general rules of Algeria's penal code.
