Economic real Estate as a mechanism to enhance the attractiveness of investment in partnership in Algeria.

Abstract

يعدُّ العقار الاقتصادي مورد هام، وأحد عوامل جذب الاستثمار، واستقطاب اليد العاملة الأجنبية، المعوّل عليها للدفع بعجلة الاقتصاد الوطني، لذلك لا يكاد يخلو الحديث عن أبرز ركائز التنمية في الوقت الراهن دون الحديث عن أساسيات الشراكة والاستثمار، لذلك يُنظر إليها كأداة لخوض غمار المنافسة الاقتصادية الدولية، ومطمعا في خلق الثروة والقدرة على التصدير. وقد شهدت الدراسة البحث عن دور العقار الاقتصادي في تعزيز سُبُل الشراكة والاستثمار في الجزائر من خلال تحديد مفهومه، مرورا بإبراز الإطار التشريعي والمؤسساتي المنظم له، ثم الكشف عن أبرز الإشكالات العالقة بملف العقار، وذلك باعتماد المنهج التحليلي كأسلوب لتحليل النصوص القانونية الخاصة به، وقد أفرزت الدراسة نتيجة جوهرية مفادها أن استغلال العقار الاقتصادي في الجزائر يُدار بنمط واحد فقط وهو أسلوب الامتياز القابل للتنازل كنمط حصري للاستغلال في الجزائر. Economic real estate is an important resource, and one of the factors attracting investment, and attracting foreign labor, which is reliable to push the wheel of the national economy, so there is hardly talk about the most prominent pillars of development at the present time without talking about the basics of partnership and investment, so it is seen as a tool to compete in international economic competition, and coveted to create wealth and export capacity. The study witnessed the search for the role of economic real estate in promoting ways of partnership and investment in Algeria by defining its concept, passing through highlighting the legislative and institutional framework regulating it, by adopting the analytical approach, and the study resulted in the result that the exploitation of economic real estate in Algeria is managed by only one pattern, which is the method of concession assignable as an exclusive pattern of exploitation in Algeria.
