The Protected Interest on the Algeria-France Convention for Mixed Marriage Kids

Abstract

يقدّم البحث ملاحظات قانونية جوهرية على الاتفاقية الجزائرية الفرنسية لسنة 1988 المتعلقة بأطفال الزواج المختلط، والتي جاءت في ظروف خاصة لوضع حدّ لاختطاف الأطفال من وإلى الجزائر. يوضّح البحث أنّ الاتفاقية السابقة قد وُضعت لمصلحة أحد الأطراف، حيثُ تبرز أنّ الهدف الرئيسي منها تمكين الحاضنة من استرداد الطفل المحضون. هذه الاتفاقية تضمنت قواعد إجرائية تخدم في النهاية مصلحة الأم الفرنسية وليس المصلحة الفضلى للطفل. يحاول البحث سدّ الثغرات التي أغفلتها الاتفاقية من خلال اقتراح تعديلها بإدراج قواعد موضوعية تتعلّق بحلّ الرابطة الزوجية. Abstract: The paper presents an legal remarks on the Algeria- Francc convention of 1988 that treats the phenomenon of the mixed marriage which had been coming into ‎a particular issues to restrict the child abduction from/to Algeria.‎ The study shows that the previous agreement was used for the benefit ‎‎‎of ‎one party. It explores that ‎its primary purpose was to recover the ‎‎child by his incubator, however, ‎this convention included a ‎‎procedures ultimately serve of the interest of the French mother not the best ‎‎interest of the child.‎ The research attempts to fill the gaps in the convention by proposing a substantive amendment relating to the dissolution of the marriage.
