Abstract

تعتبر الأملاك الوطنية العامة من بين الأملاك التي أولى لها المشرع الجزائري على غرار باقي التشريعات أهمية بالغة نظرا للدور التي تقوم به خاصة في المجال الاقتصادي و في مجال تحقيق المنفعة العمومية، ونظرا للأهمية الكبرى التي تحتلها هذه الملكية باعتبارها أحد الركائز المؤثرة في حياة الأمم والشعوب في جميع المجالات، فقد حرصت القوانين الوضعية على أن تكفل لهذه الملكية نظام قانوني خاص يختلف عن ذلك الذي يحكم أملاك الأفراد خاصة في مجال تكوين و تثمين هذا النوع من الأملاك،و العمل على وضع أحكام قانونية تحدد و تنظم سيرها من خلال إضفاء الصفة العمومية على هذه الأملاك لتحقيق الدور المنوط بها. Abstract: Public national property is one of the properties to which the Algerian legislature, like other legislations, has attached great importance due to the role it plays, especially in the economic field and in the field of achieving public benefit, and given the great importance that this property occupies as one of the influential pillars in the life of nations and peoples in all fields, positive laws have been keen to ensure that this property has a special legal regime that differs from that governing the property of individuals, especially in the field of formation and valuation of this type of property, and properties to fulfill their assigned role
