Abstract

مع انتشار وسائل الاتصال الحديثة وحاجة المتعاقدين إلى تجسيد إرادتهم في شكل إلكتروني، أصبح من الضروري إيجاد بدائل للكتابة في مجال المعاملات والعقود الالكترونية والتخلي عن الدعامة الورقية التقليدية، لذا قام المشرع الجزائري بموجب الأمر رقم 05/10 المؤرخ في 20 يونيو 2005 بتعديل القانون المدني، حيث منح حجية الإثبات في الكتابة والتوقيع الإلكترونين على قدم المساواة مع الكتابة والتوقيع على الورق العادي وهذا حسب نص المادة 323 مكرر 1 من نفس القانون، مع مراعاة شروط الحفاظ عليها بطريقة تضمن أمنها وسلامتها كما تسمح بالرجوع إليها عند الحاجة، إضافة إلى أنها تسمح بتحديد هوية الموقع عبر توقيعه الالكتروني الذي يتخذ العديد من الأشكال كالأحرف أو الأرقام أو الرموز أو الإشارات أو أي محتوى آخر موجود في شكل إلكتروني أو رقمي وفقًا للشروط التي يحددها القانون.
