The principles for the processing of personal data collected during the Corona pandemic A Comparative study between the Human Rights Council report for the year 2023 and the Algerian legislation

Abstract

أثناء انتشار جائحة كورونا، قامت الهيئات الوطنية عبر بلدان العالم-في إطار مكافحة الفيروس القاتل- بجمع كم هائل من المعلومات والبيانات الشخصية بغية المساهمة في تتبع تطوّر وانتشار الفيروس، ووضع الاستراتيجيات الكفيلة بالسيطرة على الجائحة وآثارها الوخيمة، وقد أصدرت الهيئات التابعة للأمم المتحدة مجموعة من التوصّيات التي تضمن التعامل السليم مع البيانات التي جرى جمعها، بهدف ضمان احترام حق الخصوصية المكفول وفقا لمبادئ القانون الدولي لحقوق الانسان وكذا التشريعات الداخلية، حيث تهدف هذه الدراسة إلى التعرّف على المعايير الأممية لمعالجة البيانات الشخصية، بالمقارنة مع المعايير التي اعتمدها المشرّع الجزائري في القانون 18/07 المتعلق بحماية الأشخاص الطبيعيين في مجال معالجة المعطيات ذات الطابع الشخصي، وتم معالجة الإشكالية بالاستعانة بالمنهجين التحليلي الوصفي والمقارن، من خلال ثلاثة محاور، تناول الأول المبادئ الأممية لمعالجة البيانات الشخصية، وتطرّق الثاني لكيفية معالجة تلك البيانات في القانون 18/07، وتضّمن الثالث نتائج المقارنة بين التقرير الأممي والتشريع الجزائري الذي أظهرت الدراسة أنه وفّر أغلب الضمانات الأممية لمعالجة البيانات الشخصية سيما احترام مبدأ الخصوصية. Abstract: During the spread of the Corona pandemic, national bodies across the world. collected a huge amount of information and personal data in order to contribute to tracking the development and spread of the virus, and developing preventive and therapeutic strategies to control the pandemic and its dire effects. United Nations bodies have issued a set of recommendations that ensure proper handling of the data collected, with the aim of ensuring respect for the right to privacy .This study aims to identify international standards for processing personal data, Compared to the standards adopted by the Algerian legislator in Law 18/07 relating to the protection of natural persons in the field of processing data of a personal nature. The problem was addressed using descriptive and comparative analytical approaches, Through three axes, the first dealt with the international principles for processing personal data, the second touched on how to process that data in Law 18/07, and the third included the results of the comparison between the UN report and Algerian legislation, which the study showed had provided most of the international guarantees for processing personal data, especially taking into account respect for Privacy principle.
