The Real Estate Promoter Activity as Regulated by the Promulgation of the Law N° 04/11

Abstract

يشكل تنظيم نشاط الترقية العقارية، احد اكثر التحديات التي واجهت المشرع الجزائري، و على مر إصداره للقوانين المتعلقة بالنشاط العقاري لم يتمكن من سد الثغرات و الإحاطة بجميع الجوانب المتعلقة بهذا النشاط، الى غاية صدور القانون11/04 المتعلق بنشاط الترقية العقارية، حيث قام بتقنين نشاط اهم عنصر متدخل فيه، وهو المرقي العقاري. وعليه تهدف هذه الدراسة للتعريف بالمرقي العقاري، وإبراز الشروط والالتزامات التي فرضها المشرع الجزائري عليه من اجل ممارسة مهنته، والجزاء الإداري المطبق في حالة مخالفتها. Regulating the real estate activity has been one of the most prominent challenges faced by the Algerian legislator. Despite of the promulgation of laws related to these activities, the legislator has been unable to close the loopholes and address all aspects of this activity, until the issuance of Law 11/04, which includes the rules governing real estate activities. This law regulated the activity of the most important intervening element, which is the real estate promoter. Accordingly, this paper aims at shedding light on the promoter as the most significant actor in this field and highlighting the conditions and obligations imposed by the Algerian legislator on this latter in order to practice their profession as well as the administrative penalties applied in case of non-compliance.
