Abstract

تناولت دراستنا موضوع دراسة التأثير كوسيلة الجماعات المحلية القانونية لحماية البيئة، وذلك بهدف إبراز الصلاحيات الممنوحة بموجب التشريع والتنظيم المعمول بهما للجماعات المحلية بغرض قيامها بمهمتها في حماية البيئة والتوصل إلى تحديد مدى نجاعة هذه الصلاحيات في تحقيق هذه الحماية، وقد ركزنا على إحدى أهم الوسائل القانونية المتاحة لها لتحقيق هذه الحماية والمتمثلة في دراسة التأثير. إلا أن دراسة التأثير كوسيلة لحماية البيئة تجابهها العديد من العراقيل التي تحد من فعاليتها وتحول دون تحقيق الغرض الذي وجدت لأجله، ما يستلزم إصلاحات جدية في هذا الشأن أبرزها تكريس التكوين في مجال دراسة التأثير وتخصيص ميزانية للجماعات المحلية بعنوان حماية البيئة، وتعزيز آليات الرقابة والشفافية على استعمال دراسة التأثير وفتح مجال لمشاركة الجمهور فيها. Abstract: Our study addressed the topic of impact studies as a legal means for local communities to protect the environment. The goal was to highlight the powers granted to local communities under applicable legislation and regulations to carry out their environmental protection mission, and to determine the effectiveness of these powers in achieving this protection. We focused on one of the most important legal means available to them to achieve this protection: impact studies. However, impact studies as a means of environmental protection face numerous obstacles that limit their effectiveness and prevent them from achieving their intended purpose. This requires serious reforms in this regard, most notably dedicating training in impact studies and allocating a budget to local communities for environmental protection, and Strengthening oversight and transparency mechanisms for the use of impact studies and opening up opportunities for public participation.
