The legal framework of establishing Islamic banking windows in Algeria

Abstract

شهد القطاع المصرفي الجزائري تطورات عديدة خلال السنوات الأخيرة،أبرزها ظهور الصيرفة الاسلامية وفتح شبابيك الصيرفة الاسلامية على مستوى البنوك والمؤسسات المالية التقليدية لتقديم منتجات الصيرفة الاسلامية إلى جانب عملياتها البنكية التقليدية، وذلك بصدور النظام20-02 والتعليمة 20-03 ،بالاضافة إلى القانون النقدي والمصرفي 23-09. حيث أكدت هذه النصوص القانونية على ضرورة تمتع هذه الشبابيك بالاستقلالية المالية،المحاسبية والادارية،وحتى تتمكن من تسويق منتجات الصيرفة الاسلامية اشترط المشرع الجزائري ضرورة حصولها على شهادة المطابقة ،والترخيص المسبق من بنك الجزائر،مع ضرورة انشاء هيئة رقابة شرعية داخل البنك أو المؤسسة المالية المنشئة لهذه الشبابيك. كلمات مفتاحية: الصيرفة الاسلامية، شبابيك،الهيئة،شهادة المطابقة،الترخيص.
