Abstract

This study sheds light on the problem of scientific deficiency as a reason for exempting laboratories producing vaccines Corona virus from responsibility in the moment of the global safety imposed by this pandemic. This study has shown the concept of scientific deficiency, its legal basis, and the justifications for its introduction in the field of responsibility, In addition to controversy that it raised in the field of health, and their specificity for the considerations related to it. This study concluded that the legislations should be determine the identification of application the exemption of scientific deficiency, and the exception of health in this context, especially vaccinations, considering that the damages that result from them may appear mostly in the long and medium term.
