The need for marital competence to be codified in the Algerian Family Code

Abstract

The foundation of marriage is to ensure continuity, stability, and the formation of a family based on love and mercy.Therefor, those seeking marriage must carefully consider compatibility with their partner,as the right choice fulfills the purpose of marriage. This study highlights the importance of marital competence in achieving stability in the relationship,especially in light of societal changes that have impacted the balance between spouses in Algerian family law. It also explores the legitimate purposes of marriage and examines the role of competence in comparative laws to promote harmony between spouses.
