Towards adtopting alternatives to punishment in the digital competitive market

Abstract

 Competition authorities should adopt modern mechanisms, which are what are called in the competition law rules , precautionary reports and negotiating procedures , which are considered alternatives to penalties , especially after the failure of a number of classic repressive tools , such as fines , for example , in combating competitive practices , and their inadequacy to repair the damage resulting from manipulation with algorithms created by digital platform giants GAFAM . There is a difference between reality and what is hoped for , although these laws have the advantage of modernity , their inability to effectively regulate digital platforms and their limited application can be justified by the inadequancy of the concepts of a text with complex procedures and many conditions in a digital environment that requires flexibility and speed . Despite the economic development that the global economy has witnessed over the past two decades , it is still too early to say about the maturity of the negotiation policy , taking alternatives to punishment , and adopting a behavioral tratment policy instead of structural treatment in the digital word .
