Abstract

The social public system is a modern economic public system, characterized by a protectionist tendency for the vulnerable groups of workers in the work contract, in the face of employers in the event of abuse or unfairness on their part, affecting the rights of workers. As its rules - the social public order - aim to protect the weak party in the work contract, by ensuring the minimum legal protection for the worker, which may not be reduced in any way under pain of nullity, but at the same time it can be violated despite its character peremptory, whenever the violation involves raising the minimum level of protection established under these rules. Accordingly, and through this research paper, we will try to define the concept of the social public order, and its effectiveness in protecting the weak party in the work contract.
