The Issue of Monopoly and Digital Mergers in the Digital Economy: A Comparative Legal Study

This study aims to analyze the legal challenges related to digital monopolies and mergers in the context of the digital economy, through a comparative approach between European, American, and Algerian-Arab legal frameworks. The central question revolves around the effectiveness of current legal systems in controlling digital dominance and preventing market concentration by tech giants. The findings reveal a significant deficiency in Algerian legal adaptation, a lack of digital market concepts in national legislation, and weak institutional and analytical capacities. The comparison highlights the preventive nature of the European model versus the ex-post control approach in the United States. The study recommends incorporating new legal concepts into competition laws, creating independent national authorities, and enhancing regional and international cooperation.
