The legal system for concluding a contract for the exploitation of public Waquf properties in the context of an investment - Reading of Executive Decree 18/213 -

Abstract

  Alwaquf as an autonomous property of great importance, the objective of this study was to clarify the legal provisions governing the contract for the exploitation of public Waquf property in the context of investment, in order to strengthen the institution of Waquf and the investment of economic life, correcting the gaps and contradictions of certain texts provided by Executive Decree 18/213 of 20/08/2018, which determines the terms and conditions of exploitation of Waquf's assets intended for the realization of investment projects. This decree, which established an independent and autonomous legal system, was a turning point in the field of public Waquf land use and aspires to achieve major investment objectives.
