Abstract

Foreign investment constitutes the appropriate climate for the promotion and advancement of the national economy, especially in light of the existence of capital movement between countries, which requires effective protection for the foreign investor at the national and international levels, and accordingly, the great importance that investment plays, arbitration has been devoted as a legislative guarantee. To settle disputes that may arise between the host country and the foreign investor. It is worth noting that the Algerian legislator, in turn, tried to devote arbitration as a mechanism for resolving disputes through his legislative system, especially in light of Law No. 16-09 related to the promotion of investment, and made it one of the most important legal guarantees granted to the foreign investor and this is with the aim of attracting the foreign investor to Algeria, and creating an investment environment Effective in addition to the international convention to which Algeria has acceded and which devote effective protection, especially in light of the freedom devoted to the parties to choose the way to settle disputes, and this is due to the role it plays in encouraging this type of investment.
