Abstract

In view of the importance of the mark in the field of trade and business by distinguishing between different products, industries and services from other products, industries and services similar to it, which may differ in terms of quality and materials manufactured from them, so that the consumer prefers a certain mark from the other, and thus the owner of the mark achieves Earnings accordingly. For this purpose, all comparative legislations, whether national or international, have sought to find mechanisms to protect the mark from various forms of infringement, and to ensure that it is not violated or violate the rights arising from it by others, which stress in its entirety the need to register the mark with the competent authority to provide protection for it To enjoy and exclusively enjoy the rights resulting from it, by following certain procedures that start from submitting the application for registration, then examining it, accepting the application, and thus registering the mark and then publishing it to inform others about it. Whereas, these legislations, similar to the Algerian legislation, regards registration as a prerequisite for obtaining ownership of the mark, so that its owner enjoys all the rights contained in it and protects it from any form of infringement, whether it is at the national level when the registration is national or at the international level when it is Internationally.
