الملخص

نظرا لارتفاع الاعتداءات الواقعة على أراضي الدولة، من استغلال ونهب وتغيير لوجهتها، قام المشرع الجزائري بوضع مجموعة من القوانين التي يهدف من خلالها إلى ردع هذه الظواهر المشينة، من بينها القانون رقم 23-18 المتعلق بحماية أراضي الدولة وسبل المحافظة عليها. وتكمن أهمية هذا الموضوع في كونه يعالج إحدى القضايا المهمة والمرتبطة بشكل مباشر بالسيادة الوطنية وتحقيق تنمية اقتصادية مستدامة.

حيث سنتطرق في هذه الدراسة إلى القواعد الاجرائية المستحدثة لحماية أراضي الدولة وضمان الاستخدام العقلاني للموارد الطبيعية ومنع التجاوزات التي تضر بالمصلحة العامة، إضافة إلى القواعد المطبقة على البنايات أو المنشآت الغير شرعية المقامة على أراضي الدولة.
